Practical Problems of Genocide Tribunals

When one examines the details of how tribunals are structured, it becomes clear that no solution can yield a completely satisfactory outcome on all the competing values at stake. We see, for example, a range of approaches to the question of personal jurisdiction, that is, who should be prosecuted in a genocide tribunal. Though the approaches vary widely, each of them has both advantages and disadvantages with respect to the question of impunity. Cambodia’s 1979 People’s Revolutionary Tribunal prosecuted only two people, leaving many other culpable senior leaders untouched, along with the thousands of people who carried out the actual killing. The ICTR has indicted and/or prosecuted more than seventy people, but this is totally unsatisfactory to many Rwandans, who find tens of thousands of genocide perpetrators living among them. The ICTY has indicted some 150 individuals, creating a large and time-consuming caseload but still leaving many perpetrators harmless in the former Yugoslavia. The Ethiopian courts are prosecuting more than 5,000 suspects, though that process has been criticized for violating the rights of the accused, and in any case it still leaves low-level perpetrators beyond the reach of the law. In Rwanda, more than 100,000 persons suspected of involvement in the genocide have languished in detention for years with no prospect that they will ever receive fair trials in a court of law, solely due to the fact that the sheer numbers of accused overwhelm the capacity of the Rwandan justice system. As a practical matter, then, there may be no ideal solution to the problem of personal jurisdiction for the crime of genocide….

Another challenge in achieving justice for the Cambodian genocide has to do with the question of temporal jurisdiction, or the span of time during which applicable crimes may be prosecuted. The proposed Khmer Rouge tribunal would limit its temporal jurisdiction to the period between April 17, 1975, and January 7, 1979. Thus, only criminal acts that were committed in that time frame could be prosecuted by the Khmer Rouge tribunal. This makes sense, insofar as that was the period during which the Khmer Rouge controlled Cambodia ‘s capital and also the period of the most intense killing by the Khmer Rouge, but it is also true that the Khmer Rouge executed and otherwise abused many innocent people prior to April 17, 1975, and they also continued to carry out atrocities long after they were driven from power on January 7, 1979. By limiting temporal jurisdiction to this period, people who were victimized by the Khmer Rouge at any time outside of that tightly constricted time frame might feel as if they have been denied justice for the crimes committed against them and therefore that impunity continues to reign….

A similar set of questions could be raised with respect to the subject matter jurisdiction, or what crimes will be prosecuted. For example, a growing body of evidence suggests that rape was common at the lower levels of the Khmer Rouge security organization, particularly the rape of female prisoners who were slated for execution. Recent precedents established by the ad hoc international criminal tribunals mean that when rape is assessed as having been systematic or widespread, this could constitute a war crime or a crime against humanity. Rape in war is always a war crime, but what is new under these recent precedents, where widespread or systematic, is that it can now trigger the doctrine of “command responsibility,” putting senior leaders at risk for the crimes of their subordinates. In the Cambodian case, however, the available evidence suggests that whenever the top leadership of the Khmer Rouge uncovered such “moral” infractions by their cadre, those accused of such acts faced summary execution. Consequently, the top Khmer Rouge leaders can argue that they did everything possible to suppress such crimes, and therefore they cannot be held responsible. If, due to the limited definition of personal jurisdiction, only top leaders are prosecuted, but they are absolved of responsibility for rapes, then any woman who was raped by a lower-level Khmer Rouge cadre or soldier may feel that she has not received justice and that impunity continues. Again, it would seem that there is no universally satisfactory way to address the problem of impunity for crimes on the scale of those carried out under the Khmer Rouge.

Another set of questions has to do with the extent of international involvement in a tribunal. The ICTY, the ICTR, and the ICC are in the nature of international experiments in combating impunity. As such, these judicial institutions have been fraught with start-up difficulties. They are also enormously expensive undertakings—which is one reason that several members of the UN Security Council were reluctant to see a similar model implemented in the case of Cambodia’s Khmer Rouge. A major advantage of the ad hoc international tribunals is that they tend to provide the highest legal standards of international justice, but in so doing, they also require a great deal of time and money in order to render justice to only a small minority of the perpetrators. Moreover, with the ICTY seated in the Netherlands, and the ICTR in Arusha, Tanzania—both at some distance from the territories where the crimes were actually committed—the surviving victims who have the greatest right and need to see justice done in most cases are simply too far from the court to see any justice being done at all. On the other hand, in the Rwandan domestic prosecutions, in a country where the legal profession and the courts were totally destroyed during the genocide, the relative lack of international involvement can be seen as a factor contributing to the procedural shortcomings of the process and the long delays in rendering justice for the victims and the accused alike. The same might be said of the Ethiopian prosecutions.

Thus, there seems to be no optimum level of international involvement in tribunals designed to combat impunity. If the tribunal is entirely internationalized and seated outside the territory where the crimes were committed, there is a danger that those most in need of seeing justice done will not perceive any effective impact on impunity. Those few perpetrators who find themselves before the court will be prosecuted under alien laws and in an unfamiliar language, all far away from the scene of the crime. On the other hand, when tribunals are conducted strictly as a national affair in the immediate aftermath of terrible devastation, local judicial and political conditions may not be strong enough to deliver fair and impartial justice, as we saw with the People’s Revolutionary Tribunal in 1979. However, it may turn out that the proposed mixed model for Cambodia—with internationals on the court and with the proceedings conducted where the crimes occurred—could be a good compromise to balance these competing values.

On balance, then, when we look under the hood of international tribunals at their internal workings, it is clear that there is no ideal, one-size-fits-all solution. When weighed against the enormity of the crimes at issue, questions of personal, temporal, and subject matter jurisdiction, along with the degree of international involvement, generally tip the scales of justice toward an unsatisfying outcome.

Slave Diasporas Within Africa

According to published estimates, roughly the same number of sub-Saharan Africans—some eleven to twelve million—were coercively moved across the Sahara and into the Indian Ocean and were sent as captives into the Atlantic between about 650 and 1900. But many captives never departed sub-Saharan Africa, as historians of Africa have long demonstrated. During the eighteenth and nineteenth centuries, when the volume of sub-Saharan Africa’s external slave trades reached their apogee, as many or more slaves were newly captured and retained within the continent as were sent beyond sub-Saharan Africa into external exile. The combined volume of sub-Saharan Africa’s several external slave trades, estimated at over twenty million between 650 and 1900, also serves as a rough order of magnitude for the number of new slaves captured and retained within sub-Saharan Africa.

“A large number of slaves, probably a majority, were kept within Africa even during the peak years of the Atlantic trade,” Martin Klein has written in his history of slavery in West Africa. For sub-Saharan Africa’s trade across the Sahara, Ralph Austen, its foremost estimator, has noted that “it is harder to count slaves settled in the areas of transit, although these probably exceeded (as they did on the Indian Ocean coast) the number who traveled farther.” In his study of the demography of enslavement, Patrick Manning found that “The slave population in Africa was roughly equal in size to the New World slave population from the seventeenth to the early nineteenth centuries. … After about 1850, there were more slaves in Africa than in the New World.” Herbert Klein has written that the number of slaves held in Africa during the early eighteenth century was on the order of three to five million. The domestic impact of the ending of the transatlantic slave trade was so great that “by 1850 there were more slaves in Africa than there were in America—probably now numbering close to 10 million.”

These may be understatements. Lovejoy, for example, has estimated the slave population of the western and central Sudan in about 1900 at between three and four million, not counting slaves held in other parts of sub-Saharan Africa such as in the Sokoto caliphate of northern Nigeria, once among the largest slaveholding states in the world, where some two million were bound in captivity in about 1890. On the East African islands of Zanzibar and Pemba alone, more than 100,000 persons were claimed as slaves in the late nineteenth century, nearly half as many as in all of mainland North America in 1750 or similar to the number in the single US state of Arkansas—fifty-four times their combined size—in 1860. Even in the early nineteenth century, probably more African slaves were held in sub-Saharan Africa than in the rest of the world. Africa south of the Sahara was a source of slaves and constituted a major destination for new captives….

The African diaspora as concept must be expanded, geographically recentered, and reworked to reflect the experiences of all Africans in dispersion from their homes, or it will remain a parochial tool. Making room in the African diaspora for the diverse experiences of Africa’s forced migrants conscious of their displacement and yearning for specific homes will require scholars to think and work in new and fresh ways, to employ new data, to expand beyond familiar American locations and languages, and to adopt an explicitly global-comparative approach that does not eliminate Africa from the African diaspora. This will require transforming many current assumptions about the demography and consciousness of African communities in dispersion to appreciate how Mississippi, Martinique, Senegal, Tunisia, Hausaland, southern Somalia, the Swahili coast, the Hijaz, Oman, Baluchistan, Gujarat, and the Mascarene islands each provide unique examples of African communities and self-conceptions abroad.

Wordcatcher Tales: Brown brown, Poda poda, Upline

Among the more interesting words of Sierra Leone Krio that I learned from reading A Long Way Gone: Memoirs of a Boy Soldier, by Ishmael Beah (Farrar, Straus and Giroux, 2007), were the following.

I took turns at the guarding posts around the village, smoking marijuana and sniffing brown brown, cocaine mixed with gunpowder, which was always spread out on the table, and of course taking more of the white capsules, as I had become addicted to them. [p. 121]

Where was I from? What was it like growing up upline? Upline is a Krio word mostly used in Freetown to refer to the backwardness of the inner country, its inhabitants, and their mannerisms. [p. 184]

The call for prayer from the central mosque echoed throughout the city, poda podas crowded the streets, their apprentices hanging on the open passenger doors and calling out the names of their destinations: “Lumley, Lumley” or “Congo Town …”. [p. 190]

Most reviewers gush over the book, as a story that needs to be told, no matter how embellished it may have been.

India’s Diverse Diasporas

From India: The Rise of an Asian Giant, by Dietmar Rothermund (Yale U. Press, 2008), pp. 233-235:

The cultivation of sugar-cane in colonies such as Mauritius and the Natal province of South Africa, in Trinidad, Guyana and Surinam in the Caribbean and Fiji in the Pacific Ocean created settlements of Indian labourers as many stayed on as free labourers after their contracts had expired. In some of these places the Indians emerged as the majority of the population, but with few exceptions they did not rise above the position of labourers. Therefore the diaspora in the ex-sugar colonies is not much of an economic asset to India. Mauritius is an exception to this rule. It has shown encouraging signs of economic growth and its Indian majority dominates the politics of the island but has maintained equitable relations with the other ethnic groups. Mauritius has become a major offshore banking centre for investors who channel their investments in India through the island. This has led to the strange phenomenon whereby tiny Mauritius ranks high among the nations investing in India. Being well aware of the benefits of good relations with Mauritius, India is even prepared to protect the maritime economic zone of the island with the help of its navy….

The era of decolonization did not provide much scope for re-migration from the diaspora to India. Nor did the erstwhile colonial powers invite people of Indian origin to settle in their home countries. There were only two striking exceptions to this rule. The Netherlands became the target of a mass exodus of Indians from Surinam after that colony gained independence in 1975. This was due to the fact that the Dutch had granted citizenship to the people of Surinam and since the Indians did not get along with the Afro-American majority, they left for the Netherlands before their right of citizenship could be revoked. A similar exodus of Indians from Uganda to Great Britain had taken place after Idi Amin had established his tyrannical rule in 1971. The Indians of Uganda were not the offspring of indentured servants but had followed the Uganda railroad. The workers who built that railroad had also come from India, but almost all of them had returned to their homes in the Punjab. The subsequent immigrants from India were for the most part literate Gujaratis who manned the administrative posts of the railway or set up shops in the hinterland which had been opened up by the railway. When these people were persecuted by Idi Amin and shifted to Great Britain they did very well there as a result of their business acumen. This group of the Indian diaspora is of considerable importance for India. But, of course, the Indians who came from East Africa are only part of the Indian diaspora in Great Britain, which also consists of Indian professionals and businessmen who migrated from India to the ex-imperial country in search of greener pastures.

Another post-colonial migration which had some similarity to the export of Indian manpower in colonial times was the recruitment of Indian labour by the countries along the Persian Gulf when those countries earned millions of petro-dollars. This recruitment benefited all South Asian countries. Most of them sent unskilled labourers to the Gulf; India had the lion’s share of skilled administrative jobs. For quite some time the ample remittances of these skilled personnel filled the gap in India’s balance of payments which was usually affected by a negative balance of trade. When the first Gulf War of 1991 disrupted this profitable connection, India was hit very hard, the more so as the disaster was sudden and unexpected. When Indira Gandhi was asked in 1981 whether she could envision an Indian exodus from the Gulf similar to that from East Africa precipitated by Idi Amin, she jauntily replied: ‘The Arabs need US.’ Her successors also took this for granted and were rudely awakened by the Gulf War.

The Indian diaspora in the countries along the Persian Gulf was very different from that everywhere else. First of all it was of very recent origin. This diaspora had no second or third generation members born in the country of residence. Moreover, the Indians who came to the Gulf did not intend to settle there for any length of time. There were many educated people from Kerala among them who simply wanted to earn enough money to build a house back home. Busy construction work in the villages of Kerala provided striking evidence of this trend in the 1980s. Under such conditions there was hardly any incentive to establish Indian community centres in the Gulf countries. The Indian diaspora was not concentrated in anyone place and its members fluctuated. Nevertheless, this was the diaspora which was most important for India, due to the economic effect of its remittances. Other Indian diasporas would be less inclined to send money to India as they would rather invest it where they lived. The occasional support of poor relatives in India did not give rise to substantial remittances.

Today’s Wall Street Journal weighs in on one of the barriers to the expansion of India’s diaspora in the U.S., where “the American Association of Physicians of Indian Origin which was founded in 1984 has 42,000 members” (Rothermund, p. 235):

The Chandrayaan-I blasted off about dawn from the Satish Dhawan Space Center. It is expected to reach lunar orbit by November 8. The probe, whose principal goal is to “conduct mineralogical and chemical mapping of the lunar service,” carries five scientific payloads from India and others from NASA and the European Space Agency. With this achievement, India joins the U.S., Japan, Europe, Russia and China in the lunar club.

India deserves congratulations for the Chandrayaan-I, which attests further to that nation’s remarkable strides as an economic and scientific power. That said, we cannot fail to draw attention to how this event bears on the continuing lunacy of Congress in limiting visa quotas for highly skilled immigrants.

American universities are filled with foreign students, not least from India, getting degrees in engineering and science. Many dearly wish to stay and work in the U.S. Instead, we basically kick them out after training them, owing to the Congressional limit of 65,000 H-1B visas, which are used up the day they are released in March.

Would calling this the “pre-emptive export of jobs overseas” make it any less attractive to economic protectionists?

Why Darfur and Not …?

Black Star Journal recently linked to a long and thought-provoking post back in July by Ethan Zuckerman at My Heart’s in Accra about why the West seems much more concerned about Darfur than about a number of even more horrible conflicts in Africa.

Because you may or may not be an Africa-based journalist, let me unpack the question for a moment. There are a number of international conflicts that have claimed more lives and displaced more people than the conflict in Darfur. The Second Congo War and its ongoing aftermath is believed to have killed more than 5.4 million people, mostly due to “excess mortality” connected to disease and starvation. Other conflicts compare to Darfur in terms of brutality and displacement, but have received far less attention. War between Ugandan forces and the Lord’s Resistance Army in Northern Uganda has displaced more than a million people from their homes, and one in three boys in the region have been abducted, for periods of time or permanently, by LRA forces. The war between Ethiopia and Islamist forces in Somalia – supported by the US military – has created 1 million internally displaced persons and 450,000 international refugees.

It’s admirable that activists have been able to draw so much attention to Darfur. I’m interested in the phenomenon not to criticize focus on Darfur over other conflicts, but because I’d like to help people working on other conflicts gather attention and resources. I see Darfur as a rare example of an international crisis that’s gotten huge attention in the US despite the fact that most Americans have no direct, personal connection to the region. (I’m not the only one trying to do this – John Prendergrast, who’s focused on Darfur for the International Crisis Group, is one of several Africanists who’s started a new organization, Enough, designed to harness some of the attention around Darfur and call attention to situations in DRC, Uganda, Somalia and elsewhere.)

Agreeing with the analysis that attention paid to Darfur is unprecedented, my friend offers a two-part analysis, which I’ve modified to a three part analysis:

– The time was right. Guilt over the failure to intervene in Rwanda, especially on the part of North American and European nations, offered an opportunity to demand intervention in another African conflict.

– In the US, there was already close attention paid to Sudan by human rights and by evangelical Christian communities, based on a perception of the Sudanese civil war as a religious conflict between the Muslim north and Christian (and animist) south. (My contribution to the analysis, based on my experience talking to evangelical friends about their anti-Khartoum activism as early as 2000.)

– The conflict in Darfur has been reducible to a fairly simple media narrative, with good guys and bad guys… even thought this narrative doesn’t accurately reflect the reality on the ground.

It’s this last point my friend and I focused most of our discussion on. The process of covering the conflict in Darfur has convinced my friend that a narrative centered on a merciless proxy army raping, chasing and killing innovent civilians in an attempt to ethnically cleanse a region isn’t wholly accurate. “This isn’t good guys versus bad guys. This is bad guys versus bad guys.”

The rest of the post then provides supporting examples, and faults aid agencies like Save Darfur and reporters like Nicholas Kristof for sacrificing accuracy for advocacy.

Policing the Pirates of Puntland

The India-oriented blog, The Acorn, recently noted that the Indian navy is proposing to join the multinational effort to police the pirate-infested waters off the Horn of Africa, many of them operating out of Somalia’s “self-governing” region known as Puntland.

Among the tasks assigned to the Combined Task Force 150 (CTF-150)—an international naval task force comprising, among others, of US, British, French, Pakistani and Bahraini ships—are maritime security operations in the Gulf of Aden, Gulf of Oman, the Arabian Sea, Red Sea and the Indian Ocean. While its purpose is to deny the use of the seas to smugglers and terrorists the main problem in the area under its watch is piracy.

CTF-150 doesn’t have enough ships to secure one of the world’s busiest shipping lanes. So it advises large, slower vessels to travel in convoys so that it can better watch over them. But since this is not always possible, around one in 500 ships fall victim to pirates. Since the monthly traffic is around 1500, pirates succeed in raiding three or four ships each month.

Now the Russian navy is sending a warship to the area after one group of the pirates may have bitten off more than they can chew.

SOMALI PIRATES who seized a Ukrainian ship carrying 33 T72 battle tanks – apparently bound for the autonomous government of South Sudan – yesterday warned against any attempt by Western navies to rescue the vessel’s weapons cargo or its crew.

Januna Ali Jama, a spokesman for the pirates in the breakaway north statelet of Puntland said the pirates would soon begin the routine Somali pirate tactic of negotiating the return of the cargo ship Faina to its Ukraine state owners in exchange for a ransom.

Jama told the BBC Somali Service that the pirates demand is £18 million from the Kiev government because apart from the Russian made tanks the Faina is carrying “weapons of all kinds”, including rocket-propelled grenades, anti-aircraft guns and many hundreds of thousands of ammunition….

The pirate syndicates – of which there at least five, each about 1000-strong – operate out of Puntland, far to the north, wrapped around the Horn of Africa where the Gulf of Aden meets the Indian Ocean, which declared itself separate from the Republic of Somalia 10 years ago. Puntland is to Mogadishu what Kurdistan, semi-autonomous and far off in the northern mountains of Iraq, is to Baghdad.

Unrecognised internationally – although the British Embassy in neighbouring Ethiopia maintains close contact with the Puntland government, which is allowing oil exploration by three Western companies – little diplomatic pressure can be put on Puntland, which says piracy grew after international “sea robber” fishing fleets plundered and wrecked its rich fishing grounds. The United Nations estimates that fish worth at least £50 million a year are plundered illegally from Somali waters by Spanish and other foreign boats.

The pirates are unlikely to be unable to unload the tanks because of a lack of specialist heavy-lifting gear in the tiny ports and innumerable coves of Puntland, a barren land three times the area of Scotland which historically depended on fishing and camel and goat-herding.

But that will hardly discourage the pirates. What they want is booty, in the form of on-board cash, cargo and, most importantly, ransom money, which owners are increasingly willing to pay, given the huge values of ships and their cargoes and the daily costs of maintaining them at sea. On the same day as the Faina was captured, another Puntland pirate syndicate released a Japanese ship and its 21-member crew after a £1 million ransom was paid. The 53,000-tonne bulk carrier Stella Maris had a valuable cargo of zinc and lead ingots. And as the Stella Maris was being freed, Somali pirates were hijacking a Greek chemical tanker with 19 crew on board as it sailed through the Gulf of Aden from Europe to the Middle East.

The Faina is believed to be heading to the pirate port of Eyl, the main destination of hijacked ships where Puntland entrepreneurs run special restaurants for the hundreds of seized crewmen and where the pirates’ accountants make calculations on laptops and drive state-of-the-art land cruisers….

Worldwide, pirates attacked a known 263 large vessels in 2007, up from a reported 239 in 2006, according to Choong’s piracy reporting centre. Southeast Asia, especially the shipping lanes of the Malacca Straits between Malaysia and the huge Indonesian Island of Sumatra, used to be the world’s busiest place for pirate attacks. Better co-operation between southeast Asian nations and the consequences of the 2004 tsunami have greatly reduced the number of attacks. Many pirates operated out of Aceh, the northern province of Sumatra, but the tsunami destroyed their ports, wrecked their boats and killed many of the pirates.

Somali piracy easily tops the world table, both in terms of the number of attacks and the money made. It is the Somali financiers sitting mainly in Dubai, Britain, Canada, Denmark and Kenya who make the big money by keeping the bulk of the ransom payments. Pirates based in Nigeria and Peru are also climbing the league table.

France is now circulating a draft resolution in the UN Security Council urging nations to contribute more warships and aircraft to the fight against piracy off Somalia. While the Foreign office has ordered the Royal Navy, to the incredulity of the nation’s maritime industry, not to detain Somali pirates from fear of human rights complications, the French are being pro-active.

UPDATE: On The Atlantic magazine’s blog The Current, Robert Kaplan describes a bit of the lifestyle of these pirates.

I spoke recently with several U.S. Navy officers who had been involved in anti-piracy operations off Somalia, and who had interviewed captured pirates. The officers told me that Somali pirate confederations consist of cells of ten men, with each cell distributed among three skiffs. The skiffs are usually old, ratty, and roach-infested, and made of unpainted, decaying wood or fiberglass. A typical pirate cell goes into the open ocean for three weeks at a time, navigating by the stars. The pirates come equipped with drinking water, gasoline for their single-engine outboards, grappling hooks, short ladders, knives, AK-47 assault rifles, and rocket-propelled grenades. They bring millet and qat (the local narcotic of choice), and they use lines and nets to catch fish, which they eat raw. One captured pirate skiff held a hunk of shark meat so tough it had teeth marks all over it. With no shade and only a limited amount of water, their existence on the high seas is painfully rugged.

The classic tactic of Somali pirates is to take over a slightly larger dhow, often a fishing boat manned by Indians, Taiwanese, or South Koreans, and then live on it, with the skiff attached. Once in possession of a dhow, they can seize an even bigger ship. As they leapfrog to yet bigger ships, they let the smaller ships go free. Because the sea is vast, only when a large ship issues a distress call do foreign navies even know where to look for pirates. If Somali pirates hunted only small boats, no warship in the international coalition would know about the piracy.

South Korean “Foreigners of Convenience”

A few days ago, The Marmot’s Hole posted a translated summary of a Korean newspaper article about one way that South Korean parents are getting their children into local international schools, which are a conduit to higher education abroad. They purchase foreign residency permits from embassies of Ecuador or Mali in order to qualify their Korea-resident kids as “overseas Koreans” qualified to attend international schools.

In the case of Ecuador, all you need do is visit for a week to qualify, while Mali’s embassy in Japan can issue permanent residency visas. Both options will usually cost you about 30 million won.

As a result, some people estimate that as many as 80% of the kids enrolled in international schools are South Koreans, while the official Ministry of Education figure is 13%, because dual citizens and those with official residency overseas are counted as foreigners.

Prepositions from Body Parts

About a dozen years ago, I had a chance to review for Oceanic Linguistics an interesting M.A. thesis by John Bowden (now a professor at ANU) that was published under the title, Behind the preposition: Grammaticalisation of locatives in Oceanic languages (Pacific Linguistics, 1992). The thesis was inspired by a 1989 work by Bernd Heine’s on adpositions (prepositions and postpositions) in African languages. Here are few things that struck me.

Heine examined sources for African locatives in five categories, ON, UNDER, IN, FRONT, BACK, to which Bowden added SEA, LAND, and OUT for Oceanic languages. In both Africa and Oceania, body-part nouns provide the most common sources for locatives in the categories ON, IN, FRONT, and BACK, whereas landmark nouns (‘earth’, ‘soil’, ‘shadow’) predominate for UNDER. As might be expected, landmark nouns also predominate for SEA and LAND locatives in Oceania. The exceptional cases are instructive. For instance, in both Africa and Oceania, ‘head’ is the most common source (‘sky’ is next) for ON, while ‘face’ is the most common source for FRONT. But among some quadruped-herding populations in Africa, FRONT derives from ‘head’, while ON derives from ‘back’. Similarly, the directionals SEA(SIDE) and LAND(SIDE) nearly everywhere in Oceania derive from ‘sea, shore’ and ‘land, earth’, respectively. But among the atoll-dwelling Pukapukans and Rarotongans, the opposition comparable to SEA vs. LAND is rendered more like outside (< ‘back’, a body-part term) vs. inside (< IN, a locative reconstructible for Proto-Polynesian). I should add here that this is not only true of atolls. In two coastal languages of New Guinea, Jabêm (listed in Bowden’s sample) and Numbami, the body-part term ‘backside’ also means the outside, seaside, or windward side of an offshore island (Ja. dêmôê, Nu. dume), while ‘inside’ means the lee side facing the mainland (Ja. lêlôm, Nu. awa). Numbami also has three different words for ‘inside’: lalo, awa (< ‘mouth, hole’), and ketu (< ‘egg’). The last shows a semantic extension unattested in Bowden’s sample. The most common sources for IN are (in order): ‘tooth’, ‘belly’, ‘heart’, ‘liver’, ‘bowels’. Among the few verbal sources for Oceanic locatives are ‘precede’ (> FRONT), ‘follow’ (> BACK), and ‘exceed’ (> ON (TOP) or FRONT), none of them very surprising. Bowden alludes to a more interesting development in a footnote: locatives that come full cycle and yield euphemistic terms for body parts (‘down below’, ‘inside’, ‘backside’, etc.).

End of the Americo-Liberian Aristocracy, 1980

In his book Journey Without Maps, an account of his travels in Liberia in the 1930s, the English writer Graham Greene recorded that ‘Liberian politics were like a crap game played with loaded dice’. It was a game that Liberia’s ruling elite – the descendants of some 300 black settler families from the United States who set up an independent republic in 1847 – played among themselves with considerable relish. For more than 100 years – from 1877 to 1980 – Liberia was governed under a one-party system in which the same party, the True Whig Party, controlled by the same elite group, held office continuously, dispensing patronage, deciding on public appointments and retaining a monopoly on power – a record equalled by no other political party anywhere in the world. Elections were nevertheless taken seriously, if only to determine which family – the Barclays, the Kings, the Tubmans – emerged on top. ‘The curious thing about a Liberian election campaign,’ wrote Greene, ‘is that, although the result is always a foregone conclusion, everyone behaves as if the votes and the speeches and the pamphlets matter.’ However, he added, the system was more complicated than it seemed. ‘It may be all a question of cash and printing presses and armed police, but things have to be done with an air. Crudity as far as possible is avoided.’

As members of a ruling aristocracy, the Americo-Liberians, as they called themselves, were immensely proud of their American heritage. They developed a lifestyle reminiscent of the antebellum South, complete with top hats and morning coats and masonic lodges. They built houses with pillared porches, gabled roofs and dormer windows resembling the nineteenth-century architectural styles of Georgia, Maryland and the Carolinas. They chose as a national flag a replica of the American Stars and Stripes, with a single star, and used the American dollar as legal tender.

Just like white settlers in Africa, the Americo-Liberians constructed a colonial system subjugating the indigenous population to rigid control and concentrating wealth and privilege in their own hands. Despite their origins as descendants of slaves from the Deep South, they regarded black Liberians as an inferior race, fit only for exploitation. The nadir of Americo-Liberian rule came in 1931 when an international commission found senior government officials guilty of involvement in organised slavery.

When other West African states shed colonial rule in the 1960s, the Liberian system stayed much the same. Liberian law stipulated that only property owners were entitled to the vote, so the vast majority of indigenous Africans were effectively left without one. Small numbers were assimilated into the ranks of the ruling elite: ‘country boys’ adopted by coastal families; girls selected as wives or concubines; ambitious ‘hinterlanders’ climbing the ladder. During the 1970s a few were co-opted into government. Local administration in the ‘hinterland’ was largely run by indigenous officials. But essentially Liberia remained an oligarchy where 1 per cent of the population controlled the rest – some 2 million people.

The last of the line of Americo-Liberian presidents was William Tolbert, the grandson of freed South Carolina slaves who had served as vice-president for twenty years. A Baptist minister, he attempted a series of cautious reforms, abandoning the top hat and tail-coat traditions favoured by his predecessor, William Tubman, selling the presidential yacht and abolishing a compulsory ‘tithe’ of 10 per cent of every government employee’s salary that went to the True Whig Party. But much of Tolbert’s efforts were also devoted to amassing a personal fortune and promoting the interests of family members in the traditional manner. One brother was appointed minister of finance; another was chosen as president of the senate; a son-in-law served as minister of defence; other relatives filled posts as ministers, ambassadors and presidential aides. The crap game of Liberian politics was as highly profitable in the 1970s as in the 1930s.

Economic development in the 1960s and 1970s helped underpin the system, as well as provide new opportunities for the elite’s self-enrichment. The mainstay of the economy had initially been rubber. In 1926 the Firestone Tyre and Rubber Company leased a million acres for ninety-nine years at six cents an acre to meet the American demand for car tyres. But iron ore exports from massive, high-grade deposits in the Bomi hills then overtook rubber as the major source of foreign investment and government income. By 1970 Firestone and the Liberian Iron Mining Company were providing the government with 50 per cent of greatly increased revenues. A third source of income came from registration fees from the world’s largest ghost fleet of ships: Liberia possessed only two ships of its own, but allowed more than 2,500 vessels plying the seas to fly Liberia’s flag of convenience without the bother of inspection, for a suitable fee.

Liberia ‘s economic advances, however, served only to highlight the growing disparity between the ostentatious lifestyle of the rich elite and the overwhelming majority of impoverished tribal Africans. In 1979 – the same year that Tolbert spent an amount equivalent to half the national budget while acting as host to an OAU heads of state conference – demonstrators took to the streets in protest against a 50 per cent increase in the price of rice, the staple food of most Liberians. The price increase had been authorised by Tolbert in the hope of encouraging local production. But since one of the chief beneficiaries was the president’s cousin, Daniel Tolbert, who owned the country’s largest rice-importing firm, it was seen as another move to enrich the elite. On Tolbert’s orders armed police and troops opened fire on the demonstrators, killing dozens of them.

In the following months Tolbert struggled to contain a rising tide of discontent, colliding not just with the poor but with a new generation of the educated elite. He allowed the formation of an opposition party, but when opposition politicians called for a general strike, he had them arrested on charges of treason and sedition and banned the party.

On the night of 12 April 1980 a group of seventeen dissident soldiers led by a 28-year-old master sergeant named Samuel Doe, scaled the iron gate of the president’s seven-storey Executive Mansion, overpowered the guards and found Tolbert in his pyjamas in an upstairs bedroom. They fired three bullets into his head, gouged out his right eye and disembowelled him. His body was dumped in a mass grave along with twenty-seven others who died defending the palace. Ministers and officials were rounded up, taken before a military tribunal and sentenced to death.

Amid much jubilation, watched by a crowd of thousands laughing and jeering and filmed by camera crews, thirteen high-ranking officials were tied to telephone poles on a beach in Monrovia and executed by a squad of drunken soldiers, firing volley after volley at them. A great shout arose from the mob. ‘Freedom! We got our freedom at last!’ The soldiers rushed forward to kick and pummel the corpses.

Thus the old order ended.

Thus begins the chapter entitled “Blood Diamonds,” in which the barbarism only gets worse and worse. Few societies have solved the problem of how to overthrow recalcitrant aristocrats without descending into a period of barbarism that only serves to unduly enhance nostalgia for prerevolutionary times, as Theodore Dalrymple observes in his retrospective on Alexander Solzhenitsyn.

The Russian satirical writer Vladimir Voinovich satirized Solzhenitsyn’s Russian nationalism by depicting someone resembling him having his employees flogged in Vermont. This satirical scene, in fact, made a profound criticism of Solzhenitsyn’s political thought. Voinovich was alluding to the fact that, were it not for the horrors of Bolshevism, the pre-revolutionary Russian political tradition would be regarded as so brutal that no sensitive person of good will could be a Russian nationalist. As it was, the Bolsheviks regularly killed in a few minutes more people than the Romanovs managed in a century, giving pre-revolutionary Russian history the retrospective luster of decency, wisdom, and compassion that it did not in the least deserve. For Voinovich—and the distinguished historian of Russia Richard Pipes—Leninism had its roots in the Russian tradition as well as the Marxist one. This meant that Solzhenitsyn, while absolutely right in his uncompromising attitude to Marxist-Leninism and all its works, belonged in the category of Dostoevsky: a brilliant seer who would nevertheless have made a very bad guide.

African-Soviet Parallels before and after 1989

By the end of the 1980s, not a single African head of state in three decades had allowed himself to be voted out of office. Of some 150 heads of state who had trodden the African stage, only six had voluntarily relinquished power. They included Senegal’s Léopold Senghor, after twenty years in office; Cameroon’s Ahmadu Ahidjo, after twenty-two years in office; and Tanzania’s Julius Nyerere, after twenty-three years in office….

Out of a list of fifty African countries in 1989, almost all were one-party states or military dictatorships. Opposition parties were illegal in thirty-two states. Elections, when held, served mainly to confirm the incumbent president and his party in power. In twenty-nine countries, over the course of 150 elections held between 1960 and 1989, opposition parties were never allowed to win a single seat. Only three countries – Senegal, the tiny state of Gambia and Botswana – sustained multi-party politics, holding elections on a regular basis that were considered reasonably free and fair. Botswana, in particular, stood out as an example of a liberal democracy, tolerant of opposition activity, where the rule of law was held in respect and where economic development proceeded apace.

Yet a new wind of change was stirring across Africa. It was driven in part by widespread discontent with the corruption, incompetence and stifling oppression of Big Man rule, in part by resentment over rising unemployment, falling living standards and austerity measures that African governments were forced to implement in return for international assistance. Students were at the forefront of a wave of protests that erupted in one country after another, but other urban groups – businessmen, professionals, churchmen, labour unions and civil servants – soon joined in, demanding not just redress of economic grievances but political reform.

Events abroad, in the Soviet Union and Eastern Europe, affected the clamour for change. From the mid-1980s, as a result of Mikhail Gorbachev’s ‘new thinking’, the Soviet Union began to retreat from Africa, no longer willing or able to sustain client states that had relied upon Soviet largesse for survival. With the demise of Marxism-Leninism in Europe came its demise in Africa. When Ethiopia’s Mengistu went to Moscow in 1988 to ask for more military hardware, Gorbachev turned him down, telling him he needed to reach a negotiated settlement to the wars in Eritrea and Tigray. Having lost Soviet sponsorship and confronted by rebel advances, Mengistu renounced Marxism-Leninism and embraced the idea of a multi-party system in the hope of avoiding defeat at the hands of the rebels. The outbreak of mass street demonstrations in Eastern Europe starting in the spring of 1989 and culminating in the fall of the Berlin Wall and the departure of European dictators like Ceausescu in Romania and Honecker in East Germany provided potent examples of what ‘people’s power’ could achieve. One-party regimes now looked outmoded, in Africa as much as in Europe. Even Julius Nyerere, the most articulate spokesman for one-party systems in Africa, felt obliged to modify his support. ‘To view a one-party system in almost religious terms is wrong; he said in February 1990 after visiting Leipzig in East Germany. ‘We Tanzanians have one party as a historical necessity. But this is not a kind of divine decree. It is not proper to treat a person who floats the idea of a multi-party system as someone who has committed treason.’

The end of the Cold War, moreover, changed the West’s attitudes towards Africa. Western governments no longer had strategic interests in propping up repressive regimes merely because they were friendly to the West. Along with the World Bank, they concluded that one-party regimes lacking popular participation constituted a serious hindrance to economic development and placed new emphasis on the need for democratic reform.

In June 1990 Britain declared that the distribution of its aid programme would henceforth favour countries ‘tending towards pluralism, public accountability, respect for the rule of law, human rights and market principles’. At a Franco-African summit at La Baule in June 1990, attended by thirty-three African delegations, twenty-two of which were led by heads of state, President Mitterrand stated that French aid would be dependent on efforts towards liberalisation. He warned: ‘French eagerness to offer development aid is bound to cool off in the case of authoritarian regimes which fail to heed the need for democratisation while regimes prepared to embark on the courageous path of democracy will continue to have our enthusiastic support.’

Previously, Franco-African summits had been known as lavish, back-slapping family gatherings, full of empty talk.

It seems clear in retrospect that Soviet models of governance and Soviet models of “development” were just as effective in strangling civil society and hollowing out the private sector in postcolonial Africa as they were in the ostensibly postimperial Soviet Union, leaving failed states awash in Kalashnikovs and ruled by gangsters to deal with the new expectations, dilapidated infrastructure, and diminished foreign subsidies of the 1990s, during which Africa experienced more than its share of Bosnias and Chechnyas (though with less artillery and more machetes than in their northern counterparts).
